Weekly Legislative Report (For the week of May 6, 2024 – May 10, 2024)

As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.

As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)

① Partial Amendment to the Special Act on Promotion and Support for Saemangeum Project

This Amendment allows the exemption of preliminary feasibility surveys when necessary for the reclamation or redevelopment of land or the installation of infrastructure over a wide area for the Saemangeum Project.

② Partial Amendment to the Telecommunications Business Act

This Amendment prohibits app market business entities, who also provide basic operating systems for mobile communication terminals, from restricting the installation and usage of other app markets on smartphones or tablet computers or the installation of mobile content through other app markets without just cause.

2. Pending Bill(s)

③ Partial Amendment to the Depositor Protection Act

This Amendment extends the applicable period of the insurance premium rate limit, which is scheduled to expire this August.

3. Promulgated Bill(s)

④ Enforcement Decree of the Act on the Safety Control of Hazardous Substances

This Bill mandates the Korea Fire Institute to oversee all processes from design review to completion inspection when issuing permits for facilities that handle hazardous substances in volumes that are 1,000 times or more than the designated quantity.

4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Decree of the Petroleum and Alternative Fuel Business Act

This Amendment details the matters delegated to the Enforcement Decree, including the clarification of alternative fuel types based on their characteristics, the scope and reporting requirements for the usage history of eco-friendly refined raw materials, the designation of organizations dedicated to alternative fuels, and supplementary content for support projects.
