Weekly Legislative Report (For the week of November 28, 2022 – December 2, 2022)

As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.

As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)

① Partial Amendment to the Act on Special Measures for Reinforcement and Protection of Competitiveness of National Advanced Strategic Industry

This Amendment reduces the discretionary power of permitting and authorizing authorities and requires such authorities to submit a plan for processing authorization and permission to the Ministry of Trade, Industry and Energy within a maximum of 30 days. This Amendment also exempts preliminary feasibility surveys for projects that must be promptly implemented.

② Act on the Protection of Working People

This Act newly defines the term “working people” to broadly include employees under the Labor Standards Act as well as those who provide paid labor to employers regardless of employment relations. This Act prepares measures to protect working people by prescribing matters such as the execution and issuance of written contracts, restrictions on unfair termination of contracts, maternity leaves and protection for maternity, prohibition on sexual harassment and workplace harassment, implementation of educational training such as vocational development, etc.

③ Partial Amendment to the Trucking Transport Business Act

This Amendment extends the implementation period of the Safe Trucking Freight Rates System, which expires at the end of this year, to the end of 2025.

④ Enforcement Rule of the Wastes Control Act

This Amendment increases the types of recycling to enable pyrolysis oil from plastic waste to be recycled into raw material for petrochemicals products such as naphtha or diesel.


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Rule of the Special Act on Public Housing

This Amendment enables unmarried officer workers of large corporates in their 30s who receive an average of KRW 4.5 million per month to apply for special supply subscriptions for public rental apartments that are at least 30% cheaper than the market price.
