DR & AJU Legislation & Government Relations Consulting Center’s latest issue of its specialized legislative journal, the Policy & Business Report, is now available in digital format.
The National Assembly has proposed a number of amendments to toughening up the law prior to the advance notice of the enforcement ordinance of the Serious Disaster Punishment Act(“SAPA”).
On June 30, 2021, the Legislative Strategy Center (represented by Head of the Center Dong Eon CHA) of DR & AJU LLC (represented by Managing Partner Kyu Chul LEE) released the July 2021 issue of the specialized legislative journal, the Policy & Business (P&B) Report.
Mr. Dong Eon CHA, head of the Legislative Strategy Center, stated,
“It is predicted that the SAPA enforcement ordinance, which puts a lot of pressure on businesses, would be pre-announced in the first few days of July.” He pointed out, “Various amendments have been proposed in the National Assembly, primarily by the country’s ruling Democratic Party of Korea, to address the legal blind spot.”
Following the collapse of a building under demolition in Gwangju Metropolitan City and the fire at a distribution center run by Coupang Inc., lawmaker Young Bae KIM from the Democratic Party of Korea introduced an amendment bill that will add accidents caused by construction demolition to the list of serious accidents.
Additionally, lawmaker Eun Mi GANG from the Justice Party announced the introduction of an amendment bill that will regulate places of business with fewer than five employees and abolish the grace period for places of business with fewer than fifty employees.
Mr. Seung Cheol LEE, a Senior Advisor at DR & AJU, stated, “It is expected that the enforcement ordinance of the SAPA won’t reflect the business circles’ demands for improvements.” He further commented, “Since a lengthy legal dispute is anticipated as a result of the SAPA’s ambiguity, businesses must establish preventive safety and health management systems and follow-up legal response systems with the assistance of law firms.”
