DR & AJU Legislation & Government Relations Consulting Center’s latest issue of its specialized legislative journal, the Policy & Business Report, is now available in digital format.
The Serious Accident Punishment Act will come into effect on January 27 – Businesses must inspect accident prevention systems and promptly establish management systems to improve occupational safety and health standards.
On January 27, 2022, the Legislative Strategy Center (represented by Head of the Center Dong Eon CHA) of DR & AJU LLC (represented by Managing Partner Kyu Chul LEE) released the January 2022 issue of the specialized legislative journal, the Policy & Business (P&B) Report.
Mr. Dong Eon CHA, head of the Legislative Strategy Center, stated,
“The Serious Accidents Punishment Act (“SAPA”), which prescribes the punishment for business owners and responsible managing officers who fail to fulfil their duties to take safety and health measures in the event of a serious accident, will come into effect on January 27.” Noting that, “if a serious accident happens, it is highly likely that the responsible managing officer will be subjected to investigations and trials for several years,” Mr. Cha suggested, “a safety management system should be established at a corporate level.”
Mr. Seung Cheol LEE, a Senior Advisor at DR & AJU, stated, “In particular, the government party has preannounced the strictest restrictions on industrial accidents and has been promoting the enactment of the Special Act on Construction Safety, which imposes safety responsibility on every construction agent.” Mr. Lee emphasized that “corporations must thoroughly inspect safety and health systems,” and that “government authorities and judicial authorities should apply the law in a practical manner while supplementing and amending excessive or ambiguous aspects.”
