Weekly Legislative Report for the week of  ㅡMay 9, 2022 – May 13, 2022

 
 
As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.

As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
 
① Partial Amendment to the Industrial Accident Compensation Insurance Act

This Amendment i) abolishes “exclusivity requirements” from the application of industrial accident compensation insurance for employees in special types of employment and platform operators, ii) imposes an obligation to provide data on platform operators, iii) establishes the concept of average remuneration for the calculation standards for industrial accident compensation insurance, iv) stipulates the approval standards for workers’ occupational accidents, and v) abolishes the application system that excludes workers.

② Partial Amendment to the Act on Redevelopment of Harbors and Development of Their Environs

This Amendment allows the organization of a port redevelopment project promotion council including project implementers, tenant companies, landowners, and local residents as well as the government to promote port redevelopment projects.

③ Partial Amendment to the Broadcasting Act

This Amendment stipulates the total assets of business groups, which is the standard for the restriction of ownership of terrestrial broadcasting business entities by law, not Presidential Decree.


3. Promulgated Bill(s)

④ Enforcement Decree of the Issuance and Distribution of Electronic Bills Act

This Bill expands the scope of corporate business entities that are obliged to issue promissory notes as electronic bills from businesses with total assets of KRW 1 billion or more to KRW 500 million or more.


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Public Notice on Standards for Imposition of Penalty Surcharges on Business Entities in Violation of the Fair Transactions in Franchise Business Act

This Bill imposes penalty surcharges up to 2% of the relevant sales if franchise headquarters conducts advertising and promotion events without advance consent of franchisees and passes over the expenses to the franchisees.
