Guide to the 2026 Overseas Construction Integrated Consulting Support Program

The Ministry of Land, Infrastructure and Transport (MOLIT) is operating the "2026 Overseas Construction Integrated Consulting Support Program" through a program commissioned to the International Contractors Association of Korea (ICAK). The program is designed to support small and medium-sized enterprises (SMEs) and mid-sized companies registered as overseas construction businesses in addressing legal, labor, tax, and practical challenges, as well as risks arising from geopolitical developments in the Middle East.

D&A LLC is participating in the program as the legal advisory firm, providing comprehensive legal counsel throughout the lifecycle of overseas construction, plant, energy, and infrastructure projects, from bidding and contract negotiations through contract performance, claims management, and international dispute resolution. Going beyond merely reviewing contractual language, D&A provides concrete and practical solutions that reflect the business and technical characteristics of each project, so that participating companies can apply them in actual negotiations and decision-making.

ㅇ Pre-Contract Stage
Reviews pre-contract documents, including bidding conditions, RFPs, LOAs, and MOUs, and identifies key legal and contractual risks. Provides advice on project execution structures, including consortiums, joint ventures, and subcontracting arrangements, as well as negotiation strategies with the client.

ㅇ Contract Formation Stage
Reviews Korean- and English-language contracts, including EPC contracts, construction and subcontracting agreements, joint performance agreements, and supply agreements.
Provides specific proposed revisions and negotiation alternatives regarding the scope of work, payment terms, design changes, extensions of time, liquidated damages, limitations of liability, guarantees, contract termination, and dispute resolution provisions. Contracts can be reviewed regardless of the governing law, the client’s nationality, or the location of the project site, with cooperation from local law firms where necessary.

ㅇ Contract Performance and Dispute Prevention Stage
Analyzes relevant contracts and supporting documentation in connection with potential disputes, including non-payment of amounts due for construction work, additional works, delays in project completion, suspension of works, demands for payment under guarantees, imposition of liquidated damages, and unilateral contract termination.

Provides step-by-step response strategies, including reservation of rights, submission of claims, negotiations, and preservation of evidence. Supports the preparation and dispatch of notices, claim documents, and certified letters in Korean and English.

ㅇ International Dispute Resolution Stage
Provides comprehensive advice and representation, drawing on extensive experience in international litigation related to overseas construction projects and arbitration proceedings before major international arbitral institutions, including the ICC, SIAC, HKIAC, and KCAB INTERNATIONAL, covering dispute strategy, claims and defenses, damages assessment, interim relief, and the recognition and enforcement of arbitral awards.
