Weekly Legislative Report for the week of  Nov 22, 2021 – Nov 26, 2021
 
 
As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report, produced by our Legislation Strategy Center, provides analyses of plenary sessions of the National Assembly, meetings of Standing Committees, and Subcommittee. In addition, the Center has been co-hosting the Future Leaders Forum with the Herald Business, inviting Chairpersons of Standing Committees to discuss relevant legislative issues and tasks.
 
As an extension to the service, the Center has also been issuing the Weekly Legislative Report covering various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major dailies. The report will be released with an update on newly proposed or pending Bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
 
① Partial Amendment to the Telecommunications Business Act
 
This Amendment inserts new Article 34-3 (Execution of Contracts for the Use of Information and Communications Network Services) in the Telecommunications Business, which prescribes that a service provider shall execute a contract upon the request by another service provider regarding the usage and provision of the information and communications network.

② Partial Amendment to the Fair Transactions in Subcontracting Act

This Amendment allows the subcontractors to re-subcontract when they lack the expert skills necessary during the construction or service delivery process. It also mandates subcontractors to take charge of safety management and compensation for damages in case of re-subcontracting with the approval of the Korea Fair Trade Commission.


2. Pending Bill(s)

③ Partial Amendment to the Personal Information Protection Act
 
This Amendment modifies the calculation base for administrative surcharges from particular sales revenue that concerns the violations to the total sales. The maximum price of the administrative surcharges will be up to 3%.
 
3. Promulgated Bill(s)

④ Enforcement Decree of the Occupational Safety and Health Act

This Bill mandates occupational safety and health education to four special employment type workers, including door-to-door salespersons.



4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Public Notice of Partial Amendment to the Guidelines for Allocation and Revocation of Greenhouse-Gas Emission Permits

This Bill provides benefits to companies subject to allocation participating in reducing greenhouse gas (“GHG”) emissions in permits allocation and prevents disadvantages of permits due to the emission reductions.
