Weekly Legislative Report For the Week of Sep 27, 2021 – Oct 1, 2021
 
As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report, produced by our Legislation Strategy Center, provides analyses of plenary sessions of the National Assembly, meetings of Standing Committees, and Subcommittee. In addition, the Center has been co-hosting the Future Leaders Forum with the Herald Business, inviting Chairpersons of Standing Committees to discuss relevant legislative issues and tasks.
 
As an extension to the service, the Center has also been issuing the Weekly Legislative Report covering various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major dailies. The report will be released every Wednesday with an update on newly proposed or pending Bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
①Partial Amendment to the Mobile Device Distribution Improvement Act

The Bill prohibits mobile phone manufacturers from refusing or delaying the supply or sale of parts and equipment necessary for mobile phone repair without a valid reason. It also bans the installation and operation of the software that restricts mobile phone repair. In breach of the Act, the Korea Communication Commission shall impose a corrective order or fine.

②Partial Amendment to the Fair Transactions in Subcontracting Act

The Bill obligates prime contractors to pay subcontract consideration in separation from wages and secure a means of guaranteeing payment of wages. In case of a business shut down due to reasons attributable to the contractor, the Amendment imposes joint responsibility for the payment of shutdown allowances.

③Partial Amendment to the Act on Special Measures for the Promotion of Venture Businesses

The Bill allows unlisted venture companies to issue multiple voting shares to their founders.


3. Promulgated Bill(s)

④Medical Service Act

The Bill mandates the installation of closed-circuit televisions (CCTV) inside operating rooms in medical institutions where medical personnel perform surgeries on patients in unconsciousness under general anesthesia. In such a case, the State and local governments shall subsidize the expenses needed for the installation of the CCTV.


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤Partial Amendment to the Act on Procedures and Methods for Applying for Assignment of Radio Frequencies

The Bill shortens the period of examination for frequency assignment from three months to one month and simplifies application documents.
