Weekly Legislative Report for the week of  ㅡ September 5, 2022 – September 9, 2022


As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.

As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)

① Partial Amendment to the Corporate Tax Act

This Amendment requires oil businesses and banks to calculate their excess profits by comparing the corporate tax bases with the corporate tax bases for the five years from 2015 to 2019 and to pay 50% of such earnings as corporate tax.

② Partial Amendment to the Mobile Device Distribution Improvement Act

This Amendment prohibits mobile communications terminal device manufacturers from forcing mobile communications business operators to bear additional costs such as advertising fees.


2. Pending Bill(s)

③ Special Act on the Promotion of Wind Power Generation

This Bill integrates the administrative procedures required for the establishment and construction of wind power generation facilities into one institution and entrusts the institution with the authority and responsibility for certification of these facilities.


3. Promulgated Bill(s)

④ Enforcement Decree of the Act on Fair Transactions in Large Retail Business

This Bill exempts large retail business entities from surcharges if they pay the price of delivered goods and interest for delay within 30 days from the date that the Fair Trade Commission commences the investigation.


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Enforcement Decree of the Framework Act on Resources Circulation

This Amendment reduces the requirements for recognition of circular resources to two conditions: materials shall i) not be disposed of by incineration or landfill or sea and ii) be used for purposes that are permitted at the time of recognition.
