Weekly Legislative Report for the week of  ㅡJuly 4, 2022 – July 8, 2022


As the first-ever Korean law firm to issue specialized legislative journals, DR & AJU LLC has been publishing the monthly Policy & Business (P&B) Report since August 2019. The P&B Report provides analyses of plenary sessions of the National Assembly, as well as standing committee and subcommittee meetings. In addition, the firm has been co-hosting the Future Leaders Forum with the Herald Business, inviting chairpersons of standing committees to discuss relevant legislative issues and tasks.

As an extension of this service, DR & AJU has also been issuing the Weekly Legislative Report, which covers various legal issues at the center of public debate along with editorials and columns on the Serious Accidents Punishment Act (“SAPA”) from major daily news outlets. The report will be released with an update on newly proposed or pending bills. Enclosed is this week’s legislative report, and please refer to the P&B Report for further details.

1. Proposed Bill(s)
  
① Partial Amendment to the Fair Transactions in Franchise Business Act

This Amendment mandates that franchisees must be informed of the circumstances in cases where the KFTC imposes administrative disposition on the franchisor for providing false or exaggerated information about estimated sales when signing franchise contracts and guarantees the victims' right to claim damage compensation.

② Partial Amendment to the Trucking Transport Business Act

This Amendment deletes the sunset clause in the Safe Trucking Freight Rate System and expands the scope of cargo items covered by the system from the current two types to nine types.


2. Pending Bill(s)

③ Partial Amendment to the National Health Insurance Act

This Amendment stipulates that sickness benefits must be granted to workers with reduced or no income for more than four days due to illness or injury. Although the granted benefits will be proportionate to the income of the subscribers, they must be no less than the minimum wage.


3. Promulgated Bill(s)

④ Fair Transactions in Franchise Business Act This

This Bill requires franchisors to obtain the consent of at least 50% of the franchisees for advertisements paid by the franchisees and the consent of at least 70% of the franchisees for promotional events. The Bill adopts a consent decree system for franchise and distribution sectors.


4. Bill(s) Undergoing Pre-Announcement of Legislation/Administration

⑤ Partial Amendment to the Green Buildings Construction Support Act

This Amendment includes public buildings with a total floor area of 500 m² and apartment buildings with 30 households or more in the scope of subjects that require the obtainment of the zeroenergy building certification when establishing public buildings.
